Duties of a Guardian Ad Litem

A guardian ad litem may be appointed in any case involving the welfare of a child, whether it is related to custody, visitation, or domestic abuse. The guardian ad litem will investigate the facts of the case and report to the court via written report or testimony. The guardian ad litem becomes the eyes and ears of the Court. He or she will make recommendations to the judge based on the findings of the investigation.

During their investigation, a guardian ad litem may speak to both parents, and they may interview the children either with or without the parents being present. They may also visit the parents' homes to determine whether they have the necessary space to accommodate children and whether they can provide a safe and healthy environment. If necessary, they may also speak to others who can provide information about children's best interests, such as doctors, therapists, teachers, or extended family members.

The guardian ad litem is not an advocate or attorney for either parent. His or her sole responsibility is to protect the best interest of the child. While a judge is not required to follow the recommendations of a guardian ad litem, the findings of an investigation will often play a significant role in decisions about the allocation of parental responsibilities and parenting time. It is important for parents to cooperate with a guardian ad litem, answer questions fully and honestly, provide information that is requested, and demonstrate that they are willing to do whatever is necessary to provide for their children's needs while protecting their best interests.
